Tennessee Water Company (TWC) Affiliate Program Terms & Conditions

1. Acceptance of Terms
By registering as an affiliate (also referred to as an “Ambassador”) with the Tennessee Water Company (TWC) Affiliate Program, you agree to comply with the terms and conditions outlined below. TWC reserves the right to modify these terms at any time, and it is your responsibility to review them periodically. Continued participation in the program constitutes acceptance of any changes.
2. Eligibility & Participation
To participate in the TWC Affiliate Program, you must:
• Be at least 18 years of age.
• Provide accurate and complete registration information.
• Maintain an active AffiliateWP account.
• Adhere to all federal, state, and local laws regarding marketing, referral programs, and consumer protection.
• Agree that referrals must be real, qualified homeowners who have explicitly consented to be contacted by TWC.
TWC reserves the right to deny or terminate participation at any time for non-compliance with these terms.
3. Referral Submission Guidelines
3.1. Homeowner Consent is Required
Affiliates may only submit referrals who have expressly agreed to be contacted by TWC for a free water quality test or consultation. Bulk submissions of unverified leads, scraping public information, or any form of unauthorized contact list submission is strictly prohibited.
Affiliates found submitting leads without prior consent from homeowners will have their participation in the program immediately revoked and forfeit any unpaid commissions.
3.2. Referral Submission Process
• All referrals must be submitted through the Affiliate Portal or an authorized AffiliateWP form.
• The referral’s contact information must be complete, accurate, and up-to-date.
• The referral must be a homeowner who is interested in discussing water quality solutions.
• Affiliates may not submit referrals on behalf of another person or use deceptive means to obtain homeowner information.
TWC reserves the right to verify leads before approval. Any suspected fraudulent or deceptive submissions will result in immediate termination from the program.
4. Commission & Payout Structure
4.1. Commission Amount
• Affiliates will receive $500 per successful referral that results in a fully installed and funded TWC water filtration system.
• Commission payments are only issued after the referred customer has completed installation and TWC has received full payment from the homeowner or financing institution.
4.2. Payment Schedule
• Payouts are issued on a monthly basis for all qualified referrals completed within the prior month.
• Payments are made via PayPal, direct deposit, or check.
• Affiliates must have a valid account to receive payouts.
4.3. Commission Denial or Adjustment
TWC reserves the right to deny, revoke, or adjust commission payments under the following circumstances:
• The homeowner cancels the installation before completion.
• The homeowner disputes their consent to be contacted.
• The lead was submitted multiple times by different affiliates, and another affiliate was deemed responsible for the sale.
• The referral was deemed fraudulent, misleading, or submitted without proper consent.
TWC has full discretion to withhold commission payments if fraudulent behavior is suspected.
5. Prohibited Conduct & Grounds for Termination
Affiliates must not engage in:
• Spamming, cold-calling, or unauthorized outreach (all referrals must be warm introductions with consent).
• Misrepresenting TWC or its services in any way.
• Running unauthorized ads (e.g., bidding on TWC’s name in paid ads).
• Submitting false, misleading, or bulk-generated leads to increase commission payouts.
• Failing to comply with any applicable laws and regulations regarding referrals and marketing.
Violating any of the above will result in immediate termination from the program and forfeiture of unpaid commissions.
6. Marketing & Brand Representation
Affiliates may use approved marketing materials provided by TWC but may not:
• Modify, alter, or create misleading content regarding TWC’s services.
• Make unverified claims about health, product benefits, or legal compliance.
• Use TWC’s branding, logo, or trademarks without explicit written consent.
Affiliates must clearly disclose their participation in the referral program when discussing TWC with potential customers.
7. Limitation of Liability
TWC does not guarantee commissions or earnings and is not liable for any potential loss, damages, or disputes arising from participation in the affiliate program. TWC also reserves the right to:
• Modify the commission structure at any time.
• Terminate or pause the referral program.
• Investigate suspected fraudulent activity at its discretion.
By participating, you acknowledge that you are acting as an independent referrer, not an employee, agent, or legal representative of TWC.
8. Dispute Resolution & Governing Law
Any disputes arising from the Affiliate Program will be governed by the laws of Tennessee. Affiliates agree to resolve disputes through arbitration rather than litigation.
9. Acceptance of Terms
By registering for the TWC Affiliate Program, you acknowledge that:
✅ You have read and understood these Terms & Conditions.
✅ You agree to follow all rules regarding referrals, lead submission, and marketing practices.
✅ You understand that violating these terms may result in forfeiture of unpaid commissions and removal from the program.
If you do not agree with any part of these terms, please do not participate in the program.
